Rent Increase Notice: 30, 60 or 90 Days? What Landlords Need to Check

How rent-increase notice periods work, why the required number of days varies, and what to verify before delivering a written notice.

There is no universal notice period

The notice required before a rent increase takes effect depends on the rental property's jurisdiction, tenancy type, lease terms, and sometimes the size of the increase. A 30-day rule in one state should never be assumed to apply nationwide.

Written notice is the safest starting point

Many jurisdictions require a formal written rent-increase notice rather than an informal call, text, or email. Service rules can also determine when the notice period begins.

California is a useful example

California's Attorney General states that residential increases of 10% or less generally require 30 days' written notice, while increases above 10% generally require 90 days' notice under Civil Code section 827. Separate rent-cap laws may still make an increase above 10% unlawful for a covered unit.

Before sending a notice

Confirm the state and local rule, calculate the proposed increase, review the lease, identify the required notice period and service method, and keep a copy of the final notice and proof of delivery.
