North Dakota does not impose a general statewide percentage cap on ordinary private residential rent increases, and N.D.C.C. § 47-16-02.1 prohibits political subdivisions from controlling rent on private residential or commercial property while preserving control of residential property in which the political subdivision has a fee-title interest. For a month-to-month lease, § 47-16-07 and current North Dakota Attorney General guidance allow the landlord to change rent or other lease terms with at least 30 days' written notice before the end of the month; the Attorney General separately states that rent generally cannot be raised until after a fixed lease period ends. If a landlord changes month-to-month terms under § 47-16-07, § 47-16-15 gives the tenant a 25-day termination path. Mobile-home park month-to-month tenancies use a separate § 47-10-28 framework requiring at least 90 days' notice before a rent increase, with an additional six-month restriction for a purchaser when rent was increased within the preceding 60 days.
