South Dakota Code § 43-32-13 provides a specific month-to-month lease-modification mechanism: written notice at least 30 days before expiration of the month may change rent or other lease terms effective when that month expires if the tenant remains. The tenant may instead terminate effective the first day of the next month by notifying the landlord within 15 days after receiving the modification notice. Because § 43-32-13 expressly applies to month-to-month leases, Max Rental Tools does not apply that 30-day figure automatically to a fixed-term or otherwise different tenancy. Section 6-1-13 prohibits local government rent control of private residential property, subject to its government-property exception, and § 43-32-27 separately protects against specified retaliatory conduct including certain above-fair-market rent increases after protected tenant activity.
