Free Rent Isn't Always Simple: Documenting Concessions and Early Move-Out Terms

Free-rent specials need clear written terms. Learn what leasing teams should document about credits, timing and any lawful repayment condition.

Write the economics plainly

Identify the contractual rent, exact concession, when it is applied and the lease term connected to the offer. Avoid relying on an effective-rent advertisement as the tenancy record.

National market context is not a legal rule. Lease terms and state/local law control the actual tenancy. Verify the rental property's jurisdiction and written agreement before acting.

Do not invent a clawback after the fact

If a lawful repayment condition is part of the offer, it should be explicit before signing. Whether a condition is enforceable can depend on the agreement, jurisdiction and circumstances.

Keep marketing and accounting aligned

The listing, leasing explanation, executed agreement, concession record and resident ledger should not describe different deals. Preserve the final accepted version.

Use a separate termination workflow if the tenancy ends

A concession question does not replace the need to document an early termination, assignment or other move-out arrangement accurately.
