California ADU Rental Documents Checklist: What Owners Should Have in 2026

Start with the rental relationship, not a pile of forms

Identify whether the tenancy will be fixed-term or periodic, which utilities and property areas are shared, and which local rules apply. Those facts determine which documents are useful and which legal requirements need separate verification.

California HCD guidance addresses ADU development and local implementation, while an occupied ADU is also a residential rental relationship subject to applicable landlord-tenant rules.

Before approval: application and screening records

Use a consistent rental-application workflow and keep applicant communications and screening-fee records where applicable. Screening practices must comply with applicable federal, state and local requirements.

If consumer-report information contributes to an adverse decision, additional notice requirements can apply.

At signing: choose the agreement matching the tenancy

A fixed-term Residential Lease Agreement and a Month-to-Month Rental Agreement serve different tenancy structures. California DRE recommends written rental agreements and identifies core terms that should be addressed, including rent, deposits, utilities, occupants, pets, repairs, subletting and entry.

Add only addenda matching the actual arrangement. Do not assume a generic internet lease contains every California or local disclosure required for a particular property.

At move-in: preserve money, condition and access records

Keep a factual receipt for security-deposit and move-in funds actually received, a move-in condition report, appropriate condition photographs, and a record of keys, remotes or access devices issued.

California security-deposit rules include specific documentation requirements, so verify current guidance rather than relying on an old landlord checklist.

During and at the end of the tenancy

Use written records for material amendments, approved occupant changes, maintenance requests, repair completion, lawful entry notices, rent payments, renewals and rent changes. An ADU label alone does not establish an exemption from every tenant-protection rule.

At move-out, preserve possession/key return, condition evidence, applicable inspection records, forwarding information, lawful deduction support and final security-deposit accounting.

What lease should I use for a California ADU?

Use an agreement matching the actual tenancy: commonly a fixed-term residential lease or a month-to-month rental agreement. Clauses, disclosures and local requirements depend on the property and tenancy.

Is every California ADU exempt from rent control?

No. Do not infer exemption solely from the ADU label. Coverage can depend on ownership, property configuration, required notices and state or local rules.
