New Mexico does not currently impose a general statewide percentage cap on ordinary private residential rent increases, and the statutory prohibition on local rent control remains in force. Current § 47-8-15(F), as amended in 2025, requires at least 30 days' written notice before the periodic rental date for a month-to-month residency and at least 30 days before the end of a fixed term for a fixed-term residency; a periodic residency shorter than one month instead requires at least one rental period of written notice. New Mexico Courts also cautions that rent cannot simply be increased during the stated term of a written fixed-term lease. Mobile-home parks are governed separately by the Mobile Home Park Act and should not be evaluated under the ordinary residential path.
